TERMS & CONDITIONS

1. Contractual Agreement

Welcome to Destination Indochina DMC ("Company", "we", "us", or "our"). By booking a bespoke travel itinerary, private charter, MICE program, or utilizing our B2B trade services across Vietnam, Cambodia, Laos, Thailand, or the Greater Mekong Region, you ("Client", "Traveler", or "B2B Partner") agree to be bound by these Terms & Conditions.

These terms apply to both direct private travelers and registered travel advisors, agencies, or tour operators acting on behalf of end-consumer clients.

2. Bookings, Deposits & Payments

Due to the exclusive nature of custom heritage access, luxury sanctuaries, and private aviation, reservations are confirmed only upon receipt of cleared funds under the following structure:

Accepted Payment Methods: Direct SWIFT/Bank wire transfers, electronic invoices (PCI-DSS encrypted card processing), or pre-approved B2B credit terms for licensed trade partners.

Notice of cancellation must be received in writing by Destination Indochina DMC via electronic mail. Cancellations trigger administrative and supplier charges based on time of notice:

4. Itinerary Adjustments & Charters

While every effort is made to operate journeys as published, Destination Indochina DMC reserves the right to alter routes, accommodations, or local transport without prior notice if required for safety, civil aviation permits, weather disruptions, or sudden local regulatory changes. Comparable luxury alternatives of equal or higher standard will always be provided.

5. Passports, Visas & Health Protocols

Travelers hold sole responsibility for maintaining valid entry documentation:

• Passport Validity: Passports must remain valid for at least 6 months beyond the intended date of departure from Indochina, with minimum 2 blank visa pages.
• Visas: Clients are responsible for obtaining required e-Visas or visas-on-arrival, though our concierge team provides official approval letter assistance upon request.
• Health & Vaccinations: Travelers must comply with regional entry health regulations and disclose medical conditions or mobility limitations during booking.

6. Comprehensive Travel Insurance & Liability

Comprehensive international travel insurance is **mandatory** for all guests embarking on itineraries operated by Destination Indochina DMC. Policy coverage must include full medical evacuation, repatriation, trip cancellation, and luggage protection.

Limitation of Liability: Destination Indochina DMC acts as an agent and destination operator for third-party service suppliers (airlines, private charters, hotels, rail, local boats). We accept no direct liability for injury, loss, damage, delay, or expense resulting from acts of third-party suppliers or forces beyond our reasonable control.

7. B2B Trade & Partner Portal Terms

For registered travel agencies, tour operators, and luxury advisors accessing wholesale tariffs and trade portals:

• Confidentiality: Wholesale B2B tariffs, confidential agent manuals, and net pricing structures must not be disclosed or distributed to public consumers.
• White-Label Representation: Our local field operations, guides, and executive transport will represent your brand on-site under strict white-label protocols where agreed upon.

8. Force Majeure & Governing Law

Neither party shall be liable for failure or delay in performing travel obligations if caused by Force Majeure events including acts of God, war, civil unrest, epidemic/pandemic restrictions, government border closures, civil aviation bans, or severe meteorological disasters.

These Terms & Conditions are governed by and construed in accordance with the laws of the Socialist Republic of Vietnam, with primary jurisdiction held by the competent courts of Ho Chi Minh City, Vietnam.
